Gainesville, FL Social Security Disability

If an injury or illness has left you unable to work, Social Security Disability Insurance (SSDI) benefits offer a much-needed safety net. Unfortunately, a majority of SSDI claims are initially denied. The Social Security Administration’s data shows that approximately 66 percent of disability claims on average have been denied each year over the past 10 years.

Because applying for Social Security Disability benefits can be a complicated process that often ends in denial, it’s important you have representation that will fight for the benefits that you are owed. If you have been denied SSDI benefits, you do not have to bear this burden alone. And, you do not have to give up. An initial denial does not mean that your opportunity to obtain disability benefits has been lost.

Morgan & Morgan has experienced and dedicated Social Security Disability attorneys ready to assist you. In our 35-year history, we have helped thousands of clients like you qualify for benefits that had previously been denied.

If you are unable to work because of a physical or mental disability, contact our disability attorneys today. Our Gainesville SSDI lawyers are well-versed in the complexities of disability claims and can help guide you through the process.

    Social Security Disability Appeals Process

The Social Security Administration (SSA) may deny an otherwise valid claim for a number of reasons. If your initial SSDI claim has been denied, an experienced social security lawyer may be able to appeal the denial by presenting arguments as to why you qualify for disability benefits.

For the appeal, your attorney will likely gather any necessary medical records, which could include a written opinion from the physician treating you.

The appeals process for denied Social Security disability claims can be complicated. The process includes four levels:

    • Reconsideration of a disability claim: The first level will include a full review of your application by a new Social Security reviewer. In this stage, your attorney may submit any new evidence that is available in support of your disability claim.
    • Hearing by an Administrative Law Judge: If the SSA denies a reconsideration of your claim, then your attorney may request a hearing. At the hearing, your attorney will present evidence and expert witnesses to the administrative law judge in support of your claim for disability benefits.
    • Review by the Appeals Council: If the administrative law judge denies your claim, you and your attorney may request a review by the Social Security Appeals Council. However, if the Appeals Council believes the hearing decision was correct, it can deny your request for review.
    • Federal Court Review: If the claim is still denied following the above steps, your attorney can file a lawsuit in federal court seeking to overturn the SSA’s denial of benefits.
