Biography

Biography Overview

Mitchell A. “Mitch” Schermer is a partner and trial lawyer with Morgan & Morgan’s Business Trial Group in Tampa, Florida. Mitch’s practice is dedicated to the representation of businesses, individuals, organizations, and associations in construction disputes. Specifically, Mitch focuses his practice on construction defect litigation, representing property owners, organizations, and associations whose homes, buildings, and/or infrastructure have been damaged due to defective construction and improper design practices. In addition, Mitch handles construction lien and payment dispute issues on behalf of both owners and contractors. The cases Mitch handles are complex, highly technical, and usually involve multiple parties; it is for these reasons that Mitch is proud to have recovered millions of dollars for his clients through high-stakes actions in courts throughout Florida and across the country. Though Mitch’s current practice is almost exclusively dedicated to construction litigation, he has recovered significant sums of money for clients in commercial litigation matters arising from business torts, breaches of contract, partnership disputes, professional liability, and real estate matters.

Because Mitch litigates cases exclusively on a contingency-fee basis, clients can expect that Mitch will work tirelessly to assist them in obtaining the justice that they deserve, even against the largest and deepest-pocketed adversaries, including against some of the nation’s largest homebuilders and developers. The success fee model allows Mitch to invest significant time and resources in each case, putting his clients in the best position to right wrongs, and to be fairly and adequately compensated for their damages. Whether it be through trial, motion practice, or a negotiated resolution, Mitch’s clients can expect that his full effort and attention will be directed toward assisting them resolve their dispute to their satisfaction.

Mitch is rated “AV-Preeminent” by Martindale-Hubbell, demonstrating that his peers view him as exhibiting the highest level of legal skill, acumen, and ethical standards. This distinction is only awarded to approximately 10% of lawyers nationwide. Prior to joining Morgan & Morgan, Mitch cut his teeth representing insurance companies and their insureds in complex construction defect matters and in catastrophic personal injury cases. These experiences taught Mitch how insurance companies and corporate defendants approach litigation files and evaluate risk, putting him in an advantageous position to now litigate against these same entities.

Mitch is a graduate of Stetson University College of Law where he served as Student Bar Association President in his third year. While in law school Mitch worked as a research assistant focusing on consumer protection law and antitrust; he also served as a judicial intern with the Sixth Judicial Circuit in Pinellas County, Florida.
