Memphis Statute of Limitations

A wrongful death claim may be filed when the death of an individual occurs as a result of the negligence, carelessness, or recklessness of another person or entity. At Morgan & Morgan, we understand that the unexpected passing of a loved one is always difficult for the family. For every legal proceeding, though, there is a specified time period during which a lawsuit must be brought for the claimants to receive a reward. This is called a statute of limitations, and it may be different for each state and for each realm of law.

Once this specified time period expires, the courts no longer have the jurisdiction to punish violators and offer compensation to victims, and lawsuits may no longer be filed (except under certain circumstances). For this reason, it is essential for the deceased's family to begin the process of preparing a case soon after a wrongful death accident occurs.

Has a loved one been killed in an accident possibly caused by the actions or negligence of another? If so, you may be able to seek compensation for the suffering of the victim and for your losses, both emotional and financial. But due to statutes of limitations, you have a limited amount of time to file a lawsuit. Do not hesitate to contact our trusted wrongful death lawyers today by filling out ourfree case evaluation form on the right.

  • Tennessee Wrongful Death Statute of Limitations

For most wrongful death cases in the state of Tennessee, claims for damages must be filed within one year of the date of the death. In some cases, there may be exceptions that extend this statute of limitations. As this is an extremely small timeframe to initiate a lawsuit, it is generally necessary to begin speaking with an attorney and preparing a case soon after a wrongful death accident.

  • Arkansas Wrongful Death Statute of Limitations

If you or a loved one passed away due to the actions or negligence of another, the statute of limitations in Arkansas is three years. For medical or other professional malpractice that leads to wrongful death, the statute of limitations is two years.

  • Mississippi Wrongful Death Statute of Limitations

If a loved one passed away due to the actions of another, the statute of limitations in Mississippi is generally three years, but there are exceptions. For medical malpractice, the limit is two years from incident or date of discovery with a maximum limit of seven years. Though the statute for negligence is three years, the time limit for an intentional act that led to a death is only one year after the date of death.
