Toxic Baby Formula

When a child is born prematurely, they often need extra care and nutrition to support their developing bodies and offset their initial low birth weight. Many medical professionals will advise the parents of premature babies to give their children formula during their early life, but recent evidence has suggested that some brands of formula can cause infants to develop necrotizing enterocolitis, a potentially deadly digestive condition. To make matters worse, some of the manufacturers of baby formula, Abbott Laboratories, and Mead Johnson & Company, have failed to add this life-threatening side effect to the warning label of their product, causing more unsuspecting parents to put their children at risk.

There are many things that parents of prematurely born children have to be stressed about, but an unsafe baby formula product shouldn’t be one of them. Abbott Laboratories and Mead Johnson & Company have a responsibility to ensure the safety of their products prior to sale, especially when their products are used to help premature children. Unfortunately, they have acted negligently, and families across the nation have had to endure losing their children to a seemingly safe product.

If your child has developed health concerns as a result of their baby formula, Morgan & Morgan has the experience, knowledge, and resources to help you hold the negligent organization accountable for their actions. Contact us today for a free case review.

Is There a Lawsuit Against Baby Formula Products?

To date, multiple lawsuits have been filed by parents after their children developed necrotizing enterocolitis by ingesting either Similac or Enfamil baby formula. According to the lawsuits, the manufacturers of these products failed to warn parents of the associated health risks of the formula, which has caused unsuspecting parents to give it to their prematurely born children.

    What Is Necrotizing Enterocolitis (NEC)?

Necrotizing enterocolitis is a digestive disease that occurs primarily in premature infants and can cause inflammation of the intestinal lining, which can eventually lead to serious infections. In such cases, the inflamed intestinal wall is eventually eroded away, which allows bacteria to enter the intestinal tract and jeopardize the health of the infant. The medical professional in charge of your infant’s care should monitor for the following symptoms:

    • Swollen, red, or tender stomach
    • Abdominal pressure
    • Diarrhea
    • Fluctuations in temperature
    • Abnormal breathing
    • Low blood pressure

Most infants survive the disease with serious, long-term injuries, but in more severe cases infants may lose their life. No one should have to fear for the safety of their child because of a baby formula product, and together, we can hold the negligent manufacturers accountable for their injustice.

What Baby Formula Products Can Cause NEC?

According to the scientific study, Similac and Enfamil products have been linked to digestive disease.

Which Baby Formula Manufacturers Are Being Sued?

Abbott Laboratories, the maker of Similac, and Mead Johnson and Company, the company behind Enfamil, are currently being sued by parents whose children developed health issues after ingesting their baby formula products. A recent scientific study discovered a link between their cow-milk baby formulas and dangerous digestive disease, necrotizing enterocolitis (NEC). This disease is potentially life-threatening for prematurely born children, and even minor cases can result in long-term damage that may cause digestive problems in the future. To make matters worse, the manufacturers failed to list the risks associated with their product, which has prompted parents to file lawsuits to stop their unethical behavior.

    Can Baby Formula Cause NEC?

While not all baby formula products carry a risk of digestive disease, some cow milk-based products made by Enfamil and Similac do pose a risk to a child’s health. If you have any of the following products in your home, you should dispose of them and find a safer alternative for your child:

    • Similac Special Care 20
    • Similac NeoSure
    • Similac Special Care 24
    • Similac Special Care 30
    • Similac Special Care 24 - High Protein
    • Similac Liquid Protein Fortifier
    • Enfamil Human Milk Fortifier
    • Enfamil NeuroPro EnfaCare
    • Enfamil 24 Cal

Who Is at Risk for NEC?

NEC primarily affects prematurely born infants, children born under 3.25 pounds, and newborns who are fed formula in their early life. The condition only occurs in every 2,000-3,000 births, but it’s especially dangerous to infants, as their immune systems have not developed enough to fight off harmful bacteria.

Do I Qualify for a Baby Formula NEC Lawsuit?

If your newborn child was fed cow-milk-based baby formula in the hospital, or the hospital gave you an unsafe baby formula product to take home, and your child was diagnosed with digestive health issues, you could be eligible to join the lawsuit. However, your eligibility will depend on the circumstances surrounding your case, but our attorneys can review your situation and determine whether you qualify when you contact us.

    How Can a Lawsuit Help?

No one should endanger their wellbeing by consuming a product that’s found on store shelves, especially when it’s an innocent child who’s trying to grow and develop. By taking legal action against these negligent manufacturers, we can prevent their products from causing more harm and show the industry that this kind of behavior is intolerable. You could also be eligible to recover the damage you’ve sustained, such as:

    • Medical expenses
    • Pain and suffering
    • Diminished/total loss of life’s enjoyment
    • Funeral expenses

    Does Enfamil Cause NEC?

Scientific data indicates that infants given cow-milk-based baby formula, such as Enfamil, are more likely to develop NEC than infants fed other formula products. One study found that prematurely born infants who consumed formula were six to ten times more likely to develop NEC, which is alarming considering that doctors and medical professionals recommended the formula as a safe alternative to breast milk. The data linking the risk of baby formula and NEC has been around for a little less than a decade, yet the manufacturer of Enfamil still failed to list the risk of digestive disease as a side effect of their product.

    Has Enfamil Been Recalled?

Unfortunately, the FDA has yet to recall Enfamil from store shelves despite the risk it poses to developing infants. Instead, the formula can still be purchased across the country, allowing innocent parents to unknowingly feed a toxic product to their children.
