    How Does the SSA Define Disability?

    The SSA has a five-step process for determining whether applicants are eligible for benefits. You must:

    1. Make less than $1,260 a month (as of 2020)
    2. Have limited ability to do basic work such as lifting and walking
    3. Have a condition listed on the SSA’s list of disabling medical conditions or one that’s as severe as those that are
    4. Be unable to perform any of your past work 
    5. Be unable to obtain gainful employment in another field or capacity

    What Is the Appeals Process?

    Step 1: Reconsideration

    We can file a request for reconsideration to be reviewed by an SSA claims examiner who was not a part of the initial ruling.

    Step 2: Hearing

    If your request for reconsideration is unsuccessful, we can request a hearing before a judge. Beforehand, you may be asked to provide additional evidence or clarify information about your claim.

    Step 3: Appeals Council

    If the judge doesn’t rule in your favor, we can request an appeal with the Social Security Appeals Council. They will either review your case and make a determination or return it to a judge for further review.

    Step 4: Federal Court

    If the Appeals Council chooses not to review your case or rules against you, we can file a lawsuit in federal district court.
