Where to Find Help for Los Angeles Product Liability Cases

If you need help with a product liability case in Los Angeles, finding a dedicated and experienced product liability lawyer is one of the first steps you should take. Locating a top-notch lawyer and finding yourself involved in a confusing legal system, especially when the situation is not your fault, can be a very stressful and intimidating experience. Once you come to the realization that you need a lawyer, how do you find the help you deserve? Consider the following advice when trying to decide which law firm to hire and how to go about getting the help you deserve:

Figure Out What You’re Looking For

Before finding a lawyer, the first thing you need to do is to decide exactly what it is you’re looking for. If you were injured due to a defective or dangerous product, you want to start looking for product liability lawyers or personal injury lawyers who are experienced in handling product liability claims specifically.

Once you know what kind of lawyer you’re looking for, consider the type of firm you prefer. Do you want a large or a small firm, or does it not make a difference to you? Larger firms tend to have more resources and extra support staff, which can definitely be helpful in getting a good outcome for your case. They have access to the top expert witnesses, and they have more people to help them with the more mundane tasks, such as acquiring medical records and other documentation and evidence that is crucial to the Los Angeles product liability cases. Other clients may prefer smaller firms as they find them to be a bit more personable and feel that they would be less likely to get lost in the shuffle. Ultimately, it doesn’t really matter if you choose a large or a small firm if they are both good. What matters is that you choose the attorneys who care about your case as much as you do and that you pick a firm that will be dedicated to your case.

Ask Friends & Family for Referrals

Before you start your search for lawyers, you should consider asking family and friends for personal recommendations and referrals. See if they know any personal injury or product liability lawyers. If they do, ask how they came to know them, if they’ve ever used them, if anyone else they know has used their services, and what the outcome was. If you don’t know anyone who can give you a recommendation, ask friends and family if they know any lawyers at all, regardless of what type of law they practice. If they do know someone, ask them if they can reach out to their lawyer friends for recommendations for personal injury and product liability claims lawyers. Even if your friends and family don’t know any lawyers who work in this specific area of law, some of their friends who are lawyers might.

Search Online

If you have no luck with personal referrals, you can start looking online for lawyers that can help you with Los Angeles product liability cases. Your best bet is to start with Google and just search for product liability lawyers near you. Once you have completed your initial search, it’s a good idea to carefully examine the results. Look over their websites, read the attorney bios and profiles, and see which ones would be a good choice for you. Choose a handful of attorneys or firms that sound like they might work out, and then do some deeper research. Once you compile this list, you should look at reviews for these attorneys. Finding out what former clients have to say about them is the best way to get a feel for what they’re like and how they treat clients and handle cases. Make sure you look at reviews on Google and other websites – not just the attorney’s own website. Lawyers usually handpick the reviews and testimonials that appear on their website, so you’re unlikely to find anything but positive ones there.

Set Up Free Consultations

Once you shorten your list a bit based on the reviews and your research, you should set up free consultations with a few lawyers and firms. At these meetings you can ask any important questions that you have and see if they’re even willing to take your case. You can ask about their experience, their communication style, how they view your case, and anything else you’re wondering about. After you meet with a few lawyers, you can make your decision and decide who to work with. Fortunately, all you will spend here is a little bit of time since the consultations should all be free.

  • How do you prove a product liability claim?

    There are several possibilities in how you prove a product liability claim. The answer depends on whether your case is being argued on the basis of negligence, strict liability, or other issues. Whatever the situation, you usually must prove the following:

    • The defendant designed, manufactured, distributed, or sold a defective/dangerous product;
    • The product had the defect when it left the defendant’s possession;
    • You, the plaintiff, used the product in a way that was reasonably foreseeable; and
    • You, the plaintiff, suffered injuries as a result of the defective/dangerous product
  • What does reasonably foreseeable mean in this context?

    Under California law, a manufacturer must anticipate how an average person will use a product. They must also consider how the average consumer would misuse a product. This doesn’t create a requirement that the manufacturer must eliminate all risks. However, a manufacturer must take precautions and reasonable measures to reduce the majority of these risks. Ultimately, it’s up to the jury to decide whether the plaintiff’s use of the product was reasonably foreseeable, so this determination can vary from case to case.

  • Who can be held responsible in Los Angeles product liability cases?

    There are several different parties who can be held liable if you suffered injuries due to a dangerous or defective product. It’s always going to be very fact-specific, so it’s always advisable to speak with an experienced attorney as soon as possible so you can determine if you have a valid claim and who it should be against. The following people can sometimes be held liable in these types of claims:

    • The manufacturer of the product
    • A manufacturer of certain parts of the product
    • The party who assembled the product, even if they didn’t manufacture the individual pieces that constitute the item
    • The retailer selling the product
    • A wholesaler who sells the product

    This list is not exhaustive but should give you a good idea of who can be held responsible. Keep in mind, though, that under California law, a product must be sold during the normal course of a person’s business in order for them to be held liable under product liability law. If you purchase something from a garage sale, for example, product liability laws wouldn’t apply to that seller, even if you get injured from that product.
