Sexual Assault as Defined in New York
Definitions of sex crimes can vary to a surprising degree from one state to the next. The New York Penal Law Code uses the general term “sex offenses” to describe sexual acts that occur without the victim's consent. As the state's laws explain, consent is lacking when a perpetrator uses forceful means to get the victim to partake in sexual activity. These forceful actions include physical harm and threats. Lack of consent does not automatically infer rape in New York, although that is the case in many situations.
The New York Penal Law Code also refers to another crime, “persistent sexual abuse.” This label describes the transgressions of those who engage in forcible touching after previous sex crime convictions. Other sex crimes mentioned in the code include criminal sexual acts, sexual misconduct, sexual abuse, aggravated sexual abuse, and sexually motivated felonies.
