How Is Disability Defined?
To be eligible for SSDI benefits, you have to meet the SSA’s requirements. You must:
- Make below a certain amount per month ($1,260 as of 2020)
- Be unable to do basic tasks (Difficulty walking, lifting, etc.)
- Have a medical condition on the SSA’s list of disabling conditions or one that’s just as severe
- Be unable to carry out any of your previous work
- Be unable to gain employment in a different field
How Does the Appeals Process Work?
A denied claim isn’t the end of the road. You can still appeal and recover the benefits you deserve. Here’s how the process works:
- Reconsideration
Our attorneys can file a reconsideration request with the SSA. The request is then reviewed by an examiner who was not involved in the initial denial.
- Hearing
If the reconsideration request is denied, our attorneys can request a judicial hearing. At this point, you may be asked to provide additional information relevant to your case.
- Appeals Council
Our attorneys can request an appeal from the Social Security Appeals Council. The council will review your appeal and either make a ruling or move the case to a judge for further review.
- Federal Court
If the council doesn’t rule in your favor, we can file a lawsuit in federal court. Our attorneys won’t settle for less than you deserve, and will do whatever it takes to secure a favorable outcome.
