Brooklyn Woman Struck, Killed by Cement Truck

Cement Truck

A 68-year-old woman was hit and killed by a cement truck Jan. 7 in the Borough Park neighborhood of Brooklyn, New York, the Brooklyn Paper reported. As evidenced in surveillance footage taken at the scene, the woman walking with a cane was crossing at a red light on Utrecht Avenue at the crosswalk between 48th and 49th streets at around 11:48 a.m. When the light turned green, the 48-year-old driver, apparently unaware that the woman was still in the crosswalk, accelerated into her.

First responders flocked to the rescue by the dozens but pronounced the victim dead. Authorities said the driver remained at the scene, and the New York City Police Department has made no arrests. Officials said the investigation is ongoing. According to the Brooklyn Paper’s research, 2019 saw 150 pedestrian collisions, but no fatalities, in Borough Park, making this the first such fatality in the neighborhood in over a year.

If a loved one is killed in a motor vehicle accident, you as a family member or spouse may be entitled to compensation. As the next of kin, you may be due remuneration for funeral costs, expected lifetime earnings, and pain and suffering.

However, a motor vehicle collision involving a professional driver may make matters complicated. If the driver is a direct employee of the company or institution they drive for (as opposed to an independent contractor), the company or institution may be liable. Still, the employer, or more likely the insurance company, may try to avert liability by deferring blame to the employee.

Ultimately, they might try to exhaust you with legal maneuvering, and if you don’t have an experienced attorney on your side, they may get away with ripping you off.
