  • How Fault is Determined in a Bicycle Accident

    Determining fault in a bike accident can be complicated. Most state accident laws require you to prove negligence. This means you must prove the following four points.

    1. A Duty of Care: There was a legal duty for the defendant (the at-fault driver) to act in a way that another reasonable person would have in the same situation. For example, Texas drivers must obey traffic laws and signs to keep themselves and others on the road safe.
    2. Breach of Duty: the defendant breached their duty of care. For example, if the driver was texting while driving when they hit you, they have violated their duty of care by engaging in unlawful behavior.
    3. The Breach Caused Injury: you, as the plaintiff, must prove that the at-fault driver’s breach of duty directly caused your injury.
