What is the Car Injury Settlement Process?

If you or a loved one have been involved in a car accident, you likely know how traumatic and stressful it can be. Accidents are costly, and medical bills and other expenses can damage your financial security and take a toll on your mental health. By reaching a settlement with the insurance company, you could receive the compensation you need to get your life back.

Most car accident cases are resolved through negotiations between the insurance company and the injured party. The negotiation between the two parties allows them to decide on a settlement, which will compensate the injured party for damages. Although the case does have the chance of ending up in court if both parties are unable to come to an agreement, the majority of car accident cases are resolved without issue. If your case comes to a halt and no agreement can be made, Morgan & Morgan can assist you in securing the compensation you deserve.

  • How Does the Car Injury Settlement Process Work?

After your accident, you should file a claim with the insurance provider of the negligent party. This will allow you to recover the damages resulting from your accident, such as medical expenses, emotional distress, and lost wages. Once you have filed your claim, the insurance provider of the at-fault party will begin their investigation.

Car accidents often have intricate and detailed investigations to ensure their results are accurate. At this point, your attorney will conduct their own investigation and gather evidence on your behalf. They will collect medical records, photo/video of the accident, and witness testimony to make sure your case is as strong as possible when it reaches the negotiation table.

When the investigation is complete, you will begin to draft the demand letter. This letter will describe your injuries, explain how the at-fault party acted negligently, and explicitly request compensation for the damage. The insurance company will either accept this letter and begin the negotiation or deny it altogether. If your claim is denied, you can file an appeal with a claims adjuster.

Every state has a different statute of limitations regarding car accident lawsuits, so it’s important to understand the rules that apply to you. For more information regarding your case, fill out a free, no-risk case evaluation.

  • How Much Will I Receive in My Car Accident Settlement?

The amount of compensation received in a car accident settlement can vary based on your location and the situation surrounding your case. However, here are a few common assets sought for recovery in car accident cases:

    • Medical expenses (hospital bills, medications)
    • Vehicle repair expenses
    • Pain and physical suffering
    • Lost wages (if the accident prevents you from working)
    • Emotional trauma
    • Permanent/partial disability benefits

Insurance companies use different methods for determining the value of a car accident claim. This means that one insurance company could value your case as less than another insurance company would. In some cases, they act unethically and attempt to deliberately devalue your claim. If you believe your case is worth more than what the insurance company is offering, contact us today.
