According to Google, the Incognito Mode of their widely used web browser, Chrome, offers users “private browsing” by removing web-tracking cookies and internet history from the browsing session once the browser is closed.
However, a recent lawsuit provided evidence showing that Google stores and mixes regular and private browsing data in the same logs and leverages those mixed logs to make billions in profit.
Google has claimed that they clearly state each time you open a new Incognito tab that websites might still be able to collect information about your browsing activity during your session. According to a judge who reviewed the lawsuit, however, what isn’t disclosed is that Google’s tracking technologies on those websites also collects that information.

The people suing Google claim that Google’s cookies, analytics, and tools on non-Google websites continued to track internet browsing activity even after users activated Incognito mode in Chrome. The lawsuit was filed in 2020, seeking “at least” $5 billion in damages. Google pushed to have the case thrown out, but a judge denied that request multiple times, stating, “Even if the individual data points gathered are anonymous by themselves when aggregated, Google can use them to ‘uniquely identify a user with a high probability of success.”
At this point, the case is headed for trial in January 2024.
