What Is Wrongful Termination?
Although employers in Kentucky have significant discretion over the firing of employees, some circumstances may constitute wrongful termination (also known as wrongful dismissal and wrongful discharge). For a firing to meet the standard of wrongful termination, it must be unlawful. For example, terminating someone over their religious beliefs would be a violation of federal civil rights law.
If you were wrongfully discharged, you may be entitled to compensation for your lost income and benefits, emotional distress, and other damages.
What Are Some Examples of Wrongful Termination in Kentucky?
Federal and state labor laws provide workers with certain protections. You may have been wrongfully discharged if any of the following situations led to your dismissal.
- You were fired because of your race, age, gender, or another protected characteristic
- You were let go for reporting safety concerns to your employer
- You were dismissed even though you have a contract guaranteeing you employment
- You were fired for taking leave guaranteed under the Family and Medical Leave Act
- You were let go for refusing to take part in an illegal activity at work
- You were dismissed for filing a workers’ compensation claim for your on-the-job injury
