Nuvance and Northwell Health sued over alleged ERISA violations

Morgan & Morgan has filed a class action lawsuit against Nuvance Health and its parent company, Northwell Health, for alleged violations of the Employee Retirement Income Security Act (ERISA), alleging that Nuvance improperly took funds from employee retirement accounts to offset costs for Nuvance’s contributions to the plans.

The attached complaint alleges that Nuvance’s 401k Retirement Plan required that employee forfeitures be used to cover plan expenses, including record-keeping fees. Instead of using these forfeitures to cover these expenses, Nuvance allegedly used these funds to offset the costs of their own contributions to the plan.
