[Titusville, FL] – A Brevard County jury has awarded a $3,257,353.80 verdict to a 53-year-old Titusville man over injuries he suffered in a 2023 car crash. Represented by Morgan & Morgan attorneys Nick Russo, Grant Gillenwater and Richard Russo, the plaintiff declined GEICO’s highest pre-trial settlement offer of $100,000 before ultimately being awarded the multi-million dollar verdict.
On December 28, 2023, the plaintiff was the front-seat passenger of a pickup truck driving on South Street when the GEICO-insured defendant ran a stop sign and caused a significant crash that triggered the truck’s airbags. The plaintiff was transported to the hospital on a stretcher and ultimately diagnosed with disc herniations and facet injuries in his neck and back, a torn ligament in his elbow and carpal tunnel syndrome. He underwent extensive treatment for these injuries, including epidural steroid injections, medial branch blocks, radiofrequency ablations and carpal tunnel releases.
“Our client has endured years of grueling treatment and pain that colors every day of his life because of the defendant driver’s mistake. Yet GEICO repeatedly failed to compensate him for the very injuries caused by their insured’s actions,” said Morgan & Morgan founder John Morgan and attorney Nick Russo. “Since the crash, our client struggles to sleep for more than a few hours at a time, and simple actions like household chores and tying his shoes result in agony. We’re pleased the jury awarded a verdict commensurate with the impact these injuries have had on his life.”
The case was heard by Judge Samuel Bookhardt III in the Circuit Court of the Eighteenth Judicial Circuit in and for Brevard County, Florida, Case No. 05-2024-CA-031618. The defense was mounted by GEICO-hired attorneys Troy McRitchie and Niklas Stubendorf of Banker Lopez.
