What Is Social Security Disability Insurance?
SSDI is a federal insurance program that pays benefits to people who are too injured or sick to work. To qualify, you must meet certain criteria:
- You make less than a designated amount per month ($1,260 as of 2020)
- Your injury limits your ability to do basic work (e.g, lifting, sitting, and standing) for at least 12 months
- Your condition is on the Social Security Administration’s (SSA) list of impairments or is as severe as those that are listed
- You can’t perform any of your past work due to your injury or illness
- You’re unable to procure gainful employment in a different capacity
How Can I Appeal a Claim That’s Been Denied?
Having your claim denied can have a major impact on you and your family, particularly if SSDI benefits would be your primary source of income. Although most claims are initially denied, appeals often work. Here’s how the appeals process works:
Step 1: Reconsideration
Your attorney will file a request for reconsideration with the SSA, which will be reviewed by a claims examiner who was not involved in the initial decision.
Step 2: Hearing
If the initial decision is not overturned, your attorney can request a hearing before an administrative law judge. You may be asked to provide additional evidence or clarify information about your claim. The judge may question witnesses such as medical experts.
Step 3: Appeals Council
If the judge doesn’t rule in your favor, your attorney can request an appeal with the Social Security Appeals Council. If the Council reviews your case, it will either make a determination or return it to an administrative law judge for further review.
Step 4: Federal Court
If the Appeals Council rules against you or elects not to review your case, your attorney can file a lawsuit in federal district court.
