Morgan & Morgan

  • How Can An Attorney Help?

By Explaining the Types of Social Security Benefits Available

If you are disabled, you may be entitled to one or more types of government benefits. Our lawyers can help you determine which benefits you may be eligible to collect.

Benefits that may be available to you include:

    • Social Security Disability (SSD): These benefits are available for workers who have illnesses or injuries that are included on the Social Security Administration’s (SSA) approved list of disabling conditions and that are expected to last for a least one year. To qualify for these benefits, disabled workers must have also worked for five of the previous 10 years.

    • Disabled Adult Child (DAC): These benefits are available for disabled children ages 18 to 22 whose parents are deceased or who receive SSD benefits.

    • Disabled Widow/Widower (DWB): These benefits are available for individuals who developed a disability within seven years of their spouse's deaths. To qualify, disabled workers must have been married to their deceased spouses for at least 10 years.

    • Supplemental Security Income (SSI): This supplemental income is available for workers who are disabled, blind or elderly and who have limited incomes and resources. These benefits are largely based on income history and any other government benefits the disabled worker is receiving.

By Helping You File a Claim or Appeal a Denied Claim

SSD benefits claims can be denied for many reasons, but often they are denied at the initial stage because of minor errors, such as missed deadlines and paperwork errors.

At Morgan & Morgan, our lawyers can ensure that your application is submitted in a timely fashion and that it contains thorough and accurate documentation of your disability, which may add value to your claim.

After we file your SSD claim, we can also keep track of its status to ensure it remains active. If the SSA requests further documentation of your disability, for instance, we can respond to their requests on your behalf and submit any documents needed to finish the Administration’s review of your claim.

With the high rate of denied SSA applications in Georgia, it’s possible that your claim may be denied; however, this does not mean that you are not entitled to Social Security benefits.

In fact, the majority of appealed claims in Georgia are later approved during appeals hearings with administrative law judges. Our lawyers can help you file an appeal and represent you during the complicated four-step appeals process, which includes:

    1. Reconsideration of your claim
    2. A hearing by an administrative law judge, if necessary
    3. A review by the SSA’s appeals council, if necessary
    4. Appealing your application in Georgia federal court, if necessary

If your claim is still denied after going through the first three stages, our lawyers may file an appeal in Georgia federal court, where you could receive a court order instructing the SSA to provide you with disability benefits.

At Morgan & Morgan, our firm has a reputation as a trial law firm whose lawyers are determined to bring their cases to court to get their clients full compensation for their debilitating injuries or illnesses.

  • How Much Does a Lawyer Cost in Columbus?

The lawyers in our Columbus office will only collect a fee if we can recover benefits on your behalf. This fee is typically a percentage of your awarded past-due benefits, and the percentage is strictly regulated by the SSA to ensure that disabled workers have affordable options for legal representation.

If you need help filing a disability benefits claim or appealing a denied claim, our lawyers may be able to help. For a free initial case review, contact us today.
