Tennessee’s Dog Bite Law – The Dianna Acklen Act of 2007
In 2007, the state of Tennessee enacted the Dianna Acklen Act of 2007 to help dog bite victims obtain compensation from negligent pet owners whose dogs cause injuries to innocent bystanders. The Tennessee legislature passed this law after three dogs fatally attacked Dianne Acklen while she was walking through a rural residential neighborhood in Tennessee.
What Does The Law Say?
Under the Act, a dog owner has a legal duty to maintain reasonable control over his or her dog. If a dog owner fails to do so and the animal bites an innocent bystander, the victim may be able to pursue a lawsuit and hopefully recovering compensation for medical bills and other expenses incurred as a result of his or her injury.
Even if the owner did not know the dog was dangerous or was likely to bite people, the owner can still be held liable under Tennessee law. Furthermore, even if the victim provoked the dog in some way, he or she may still be eligible to receive compensation through a dog bite lawsuit.
Is There a Time Limit for Filing a Dog Bite Lawsuit?
In Tennessee, a dog bite lawsuit generally must be filed within one year of the date of the injury. Because of this time limit, it is very crucial that you speak to a lawyer as soon as possible after being attacked.
