    FAQ
    • Mississippi "One Bite" Rule

Mississippi statutes do not adequately cover the issue of vicious dogs. However, case law has established a one-bite rule, which holds the owner liable if they knew about the dog’s propensity for viciousness. Once a dog has bitten someone, the owner is put on notice that the dog is dangerous and may be held liable if the dog bites again. However, a dog does not necessarily need to actually bite to trigger the one-bite rule. Instead, the dog need only exhibit dangerous behavior. In 1973, the Mississippi Supreme Court established the elements of dog bite recovery in [Poy v. Grayson][1]. To recover damages, the victim must prove:

      • The dog "exhibited some dangerous propensity or disposition prior to the attack"
      • The owner "knew or reasonably should have known of this propensity or disposition” for being dangerous
      • The owner “reasonably should have foreseen that the animal was likely to attack someone”

A dog bite lawyer can explain these laws to you in more detail.

    • Dog Attack Damages

A dog’s sharp fangs and claws can cause deep lacerations, puncture wounds and nerve damage. Because of its power, the dog may also knock you to the ground, causing head injuries and broken bones. Besides the physical injuries, you might also suffer lifetime psychological issues stemming from the attack. Damages you may be entitled to include:

      • Wounds and lacerations
      • Traumatic brain injury (TBI)
      • Bone fractures
      • Nerve damage
      • Scars and disfigurement
      • Pain and suffering
      • Disability
      • Animal phobias
      • Anxiety and depression
      • Post-traumatic stress disorder (PTSD)
