Man Sues Nashville After Guardrail Crash Leaves Him Paralyzed

National law firm Morgan & Morgan has filed a lawsuit against the Metropolitan Government of Nashville and Davidson County on behalf of a man who was paralyzed by a collision with a dangerous blunt end, un-flared guardrail that was allegedly installed in violation of Nashville Department of Transportation (“NDOT”) and Tennessee Department of Transportation (“TDOT”) standards.

On May 28, 2025, Daniel Freeman was driving along Pin Hook Road in Davidson County, Tennessee when he suddenly lost control of his vehicle and struck a guardrail on the side of the road. Upon impact, the guardrail allegedly speared into Daniel’s vehicle and struck him, causing severe injuries that ultimately led to permanent paralysis. Daniel was hospitalized for months due to his injuries and will never regain function of his legs.

The attached complaint alleges that the guardrail was installed in a way that was dangerous to drivers, and that given the speed limit of the road, the guardrail should have been installed with end terminals or sufficient anchors in order to make it safe should a crash take place. The complaint alleges that both TDOT and NDOT standards required that the guardrail was to be constructed in a manner to make it crashworthy, and alleges that the city of Nashville knew that the guardrail was installed in a manner that was not compliant with these standards and failed to remove it.

As a result, such failures occur far too often. We are committed to seeking justice for Mr. Freeman and holding those responsible for this tragedy accountable.”
