Meet Scott Mitchell Fischer

Scott Mitchell Fischer has recovered hundreds of millions of dollars in cases against health care facilities. He has won multi-million-dollar verdicts and settlements against hospitals, assisted living facilities and nursing homes.

Scott is a double-Gator.  He graduated from the University of Florida in 1997 and the University of Florida College of Law in 2000.  He has over 25 years of litigation experience specializing in cases involving abuse and neglect at health care facilities.

Scott began his career by representing hospitals, assisted living facilities and nursing homes, during which time he learned the inner workings of the health care industry.  After a few years working for the defense, Scott switched sides and he has been representing victims and their families for over 20 years.  Scott handles cases all across the state of Florida.

Scott is a competitor by nature. He is well known for passionately and aggressively advocating for the rights of his clients.  The defense industry is well aware of Scott’s abilities so they often try to settle his cases to avoid facing him in Court. When Scott’s cases do not settle out of Court, he is always well-prepared to obtain justice for his clients at trial.

One of the biggest signs of neglect at health care facilities is bedsores. Scott has successfully resolved countless bedsore cases by settlement, binding arbitration, and jury trials. In 2023, Scott obtained a $2,300,000 jury verdict against a nursing home in Gainesville, Florida for the development of a bedsore. Scott recently conducted a three-week jury trial against an assisted living facility in Port St. Lucie, Florida for the wrongful death of a 97-year-old woman. The trial resulted in a record verdict for a person of such advanced age, with the jury awarding six million dollars. Below is a video of a news story regarding the six million dollar verdict.

Another major sign of neglect at healthcare facilities are falls. Scott has successfully resolved countless cases involving falls by settlement, binding arbitration, and jury trials, including a recent jury trial he won in West Palm Beach, Florida against a hospital where Scott’s client fell out of a hospital bed and suffered a broken hip. The jury awarded over $900,000 to Scott’s client. Part of Scott’s closing argument from that fall case can be seen in this video.

Nursing homes and assisted living facilities often avoid jury trials by having families unknowingly sign arbitration agreements as part of the resident admission process. Hospitals can also avoid jury trials by taking advantage of Florida statutes that force arbitration. Scott fights just as hard for his clients in arbitration as he does in Court and he has obtained arbitration awards totaling millions of dollars. Scott also helped establish that binding arbitrations are not confidential and in 2024 Scott brought the first ever binding arbitration case that was broadcast on the Courtroom View Network. In that case, Scott obtained an arbitration award of over $625,000 on behalf of a 95-year-old dementia patient. Part of Scott’s closing argument from the binding arbitration can be seen here.
