During his employment, our client, a well-respected deputy sheriff, was denied payment for overtime hours he worked, in violation of the Fair Labor Standards Act (FLSA). During Mr. Caizza’s employment, the Sheriff’s Office enforced a de facto policy that prevented Deputies from recording any time worked over 84 hours during their two week pay period, despite the fact that Deputies were required to work significant overtime hours beyond those recorded. In December 2020, a jury awarded Caiazza the full amount he sought to recover in closing at trial, including damages based on a finding that the Sheriff’s Office knew or recklessly disregarded whether its conduct violated the FLSA. In addition to the amount of the verdict, the Court also awarded liquidated damages and attorneys' fees.
