Spencer Payne and Jack Cook just received a $3,076,269.20 verdict in Lake County on a nursing home fall case.
Their client was an 89 year old Korean War veteran who entered into this short-term rehab after several hospitalizations for recurrent UTI’s which saw him placed on foley catheter for more than a year.
Three weeks into stay, and days away from heading home, he fell and fractured his hip requiring surgery. Case was vehemently defended with defense blaming our poor guy who also had dementia and other co-morbidities and was there for help he wasn't getting.
Client is still alive at 91, but was so infirm that he was unable to attend the trial. His wife, who is in her mid-80’s, took up this fight on her husband’s behalf On the witness stand, she was direct, descriptive and fair.
This facility carried a 100K policy which they only offered on the Courthouse steps. Spencer bookended the case with a strong with opening and closing argument, and he proved what we all know…true belief in your case is the only foundation you ever need.
The jury awarded full past and future economics, and awarded $2.8 million to our client.
