What Is the Netflix Data Tracking and Privacy Issue?

Netflix is one of the world's largest streaming services. For years, the company offered paid subscriptions without traditional advertising and publicly distinguished its business from advertising-supported technology companies.

In May 2026, the Texas Attorney General sued Netflix, alleging that the company collected extensive behavioral information from users without adequately informing them about the scope of that collection or how their information would ultimately be used. The lawsuit alleges that Netflix tracked activity including what subscribers watched, searched for, paused, replayed, skipped, and abandoned, along with information about their devices, locations, browsing behavior, and household networks.

Florida filed a separate lawsuit in September 2026. That complaint similarly alleges that Netflix spent years representing its paid service as an alternative to advertising-driven tracking while building an extensive system for collecting subscriber behavioral data. Florida alleges that Netflix later used that infrastructure to support the advertising business it launched in November 2022.

The Texas lawsuit further alleges that Netflix made subscriber information available within an advertising ecosystem involving advertisers, data brokers, and advertising technology companies, allowing Netflix information to be matched or combined with information collected elsewhere.

Consumer law firms are now investigating potential claims on behalf of people who subscribed to Netflix before the introduction of its advertising-supported service and may have relied on Netflix's representations about advertising and data collection when purchasing or maintaining their subscriptions.

Denied Life Insurance Claims at a Glance

    Misrepresentation or Non-Disclosure Allegations

An insurer may claim the policyholder provided inaccurate or incomplete information about their health, medical history, occupation, or lifestyle when applying for coverage. Whether that information justifies denying benefits depends on the policy, the circumstances, and applicable law.

    Policy Exclusions

Insurance companies may deny benefits by arguing that the circumstances of a death fall under an exclusion, such as a suicide provision or hazardous-activity limitation. Whether the exclusion applies can depend on its specific wording and the facts surrounding the death.

    Lapsed or Expired Policies

An insurer may claim the policy was no longer active because premiums were missed or coverage had lapsed. Payment history, required notices, grace periods, and reinstatement provisions may all affect whether the denial is valid.

    Administrative Problems

Missing records, incomplete paperwork, or processing errors can delay or complicate a life insurance claim. An administrative issue does not necessarily mean a beneficiary has lost the right to pursue benefits under the policy.

    Beneficiary Disputes

Disagreements may arise over who is legally entitled to receive life insurance proceeds, particularly when beneficiary designations have changed, or multiple people make competing claims. These disputes can delay payment while ownership of the benefits is resolved.

    Do I Have a Case?

The Insurer Claims the Application Contained Misrepresentations

The insurer alleges that the policyholder provided inaccurate or incomplete information when applying for coverage.

The Insurance Company Says the Policy Lapsed

The insurer claims premiums were not paid or the policy expired before the insured person's death.

The Insurer Relied on a Policy Exclusion

Your claim was denied because the insurance company says the circumstances surrounding the death fall within an exclusion.

Your Claim Has Been Delayed or Mishandled

You have provided requested information but continue to face unexplained delays, changing explanations, or administrative problems.

    There Is a Beneficiary Dispute

The insurance company has refused to distribute benefits because there is disagreement over who should receive the policy proceeds.

Unsure Whether the Denial Was Proper?

A denial letter may sound definitive, but the insurer's interpretation is not necessarily the final word. Morgan & Morgan can review your policy and denial at no cost and help you better understand your legal options.

    Ways We Can Help

    Unpaid Life Insurance Benefits

A claim may seek payment of death benefits that should have been paid under the terms of the policy.

    Interest on Delayed Benefits

Depending on the circumstances and applicable law, beneficiaries may be able to pursue interest associated with benefits that were wrongfully withheld.

Financial Losses Caused by the Denial

Delayed or denied benefits can create additional financial hardship for families. Certain losses may be recoverable depending on the facts of the case and applicable state law.

    Bad Faith Damages

In some cases, an insurer's conduct may go beyond a simple coverage disagreement. Additional remedies may be available when an insurance company acts in bad faith, depending on applicable law.

    Litigation When Necessary

If an insurance company refuses to resolve a legitimate claim, our attorneys can evaluate whether filing a lawsuit is appropriate.

Common Reasons Life Insurance Claims Are Denied

    Misrepresentation on the Application

The insurer claims the policyholder provided false or inaccurate information when applying for coverage.

    Failure to Disclose Medical Information

The insurer alleges that a medical condition, treatment, prescription, or other health information should have been disclosed.

    Policy Exclusions

The insurer argues that the cause or circumstances of death are excluded under the policy.

    Alleged Policy Lapse

The company claims coverage ended because one or more premiums were not paid.

    Missing or Incomplete Documentation

The insurer may delay or deny a claim because it says additional documents or information are required.

    Beneficiary Disputes

Conflicting beneficiary claims or questions about a beneficiary designation may prevent an insurer from immediately distributing the proceeds.

    • What information does Netflix allegedly collect about subscribers?

The Texas Attorney General alleges that Netflix collected detailed information about how subscribers interacted with the platform, including what they watched, searched for, paused, replayed, skipped, and abandoned. The lawsuit also alleges that Netflix collected information involving devices, household networks, application usage, and other behavioral activity.

The extent of information collected about any particular subscriber may vary.

    • How do I know if Netflix tracked me?

Subscribers generally may not be able to determine the full extent of the information collected about them simply by looking at their Netflix account.

Recent lawsuits allege that Netflix's systems automatically recorded numerous interactions as consumers used the service. An attorney can evaluate your subscription history and other available information to determine whether you may have a potential claim.

    • Do I qualify if I still subscribe to Netflix?

Possibly. Continuing to use Netflix does not necessarily determine whether you have a potential privacy or consumer protection claim.

An investigation may instead focus on when you originally subscribed, the representations made about Netflix's privacy and advertising practices, how your information was allegedly collected or used, and the laws that apply where you live.

    • Why does November 2022 matter?

Netflix launched its advertising-supported subscription tier in November 2022.

Consumer attorneys are investigating claims involving people who purchased Netflix subscriptions before that change and may have relied on earlier representations about Netflix's approach to advertising and consumer data when deciding to subscribe or continue paying for the service.

    • Does this only apply to people who use Netflix's ad-supported plan?

Not necessarily. The allegations focus in part on information Netflix allegedly collected from subscribers before the company introduced its advertising-supported tier. As a result, consumers who paid for other Netflix subscription plans may potentially be affected.

Whether you have a claim will depend on your individual circumstances and applicable law.

    • Did Netflix sell my personal information?

The current allegations are more complicated than simply claiming Netflix “sold” subscriber information.

The Texas Attorney General alleges that Netflix disclosed subscriber information to commercial data brokers and advertising technology companies, where that information could be combined with data collected from other sources to create more detailed consumer profiles. Netflix disputes allegations made against it, and the lawsuits remain ongoing.

An attorney can evaluate whether the alleged collection, disclosure, or use of information may give rise to a claim under laws applicable to you.

    • What should I save if I think I may have a Netflix privacy claim?

You may want to preserve records that help establish your Netflix subscription history, including:

      • Netflix billing statements or receipts
      • Credit or debit card statements showing subscription payments
      • Subscription confirmation emails
      • Account or membership information
      • Emails or other communications from Netflix
      • Screenshots of account settings or privacy options
      • Copies of privacy notices or other Netflix communications you received

You do not need to know exactly what information Netflix allegedly collected before speaking with an attorney.

    • How much could a Netflix privacy claim be worth?

The potential value of a Netflix privacy claim depends on the facts of the case, the laws that apply, the type of claim pursued, and the relief available under those laws.

Some consumer protection and privacy laws may allow consumers to pursue financial compensation or other remedies, but there is no guaranteed amount of recovery.

An attorney can review your circumstances and explain what forms of relief may potentially be available.

    • What should I do if I think Netflix collected or used my information without my knowledge?

Consider preserving records related to your Netflix subscription and avoid deleting emails, account records, billing statements, or other information that could help establish when and how long you subscribed.

You can also speak with a consumer protection attorney who can evaluate your circumstances, determine which laws may apply, and explain your legal options.
