Indiana woman wins $825K verdict over Floyd County Crash

[New Albany, IN] – A Floyd County jury awarded a 32-year-old Indiana woman an $825,000 verdict on Tuesday over injuries she suffered in a 2023 car crash. Represented by Morgan & Morgan attorneys John L. Smith and Brandon Smith, the plaintiff declined the defense’s highest pre-trial settlement offer of just $25,000 before ultimately being awarded the six-figure verdict.
On October 31, 2023, the plaintiff was driving on State Road 64 in Georgetown, IN when the defendant driver pulled out in front of her from a parking lot, causing a serious crash. The plaintiff suffered a concussion with ongoing and severe post-traumatic headaches, as well as an injury to her sacroiliac joint that continues to cause numbness in her leg and requires ongoing radiofrequency ablations and injections. The plaintiff was forced to take this case to trial against State Farm, her own insurance company, after they failed to pay the $150,000 policy limits of her underinsured motorist coverage.

The case was heard by Judge Maria Granger in the Floyd Circuit Court, State of Indiana, Case No. 22D03-2410-CT-001822. State Farm was represented by attorney Benjamin Stevenson of Goodin Abernathy & Stevenson.
