  • Are You Eligible for Workers’ Compensation?

    Generally, to be eligible for workers’ compensation payments, you must have been injured by an accident during the course and breadth of your employment. Also, your employer must fall within the scope of the North Carolina Workers’ Compensation Act. 

    In some situations, occupational diseases such as “black lung” and even Covid 19 may be covered if you, as an employee, were at an increased risk of contracting the disease compared to the general public and if hazardous working conditions substantially contributed to the disease. Make sure the events that gave rise to your injury are well-documented.

  • What Compensation is Available?

    Under North Carolina law, for an eligible workers’ compensation claim, your employer must provide “medical treatment,” i.e. any treatment or expense that would cure the injury, lessen the disability, or relieve pain. If a doctor imposes work restrictions and/or determines that you are temporarily or permanently disabled as a result of the work-related injury, the employer may also be required to compensate you for lost wages. If your loved one has died as a result of an on-the-job injury or occupational disease, their dependents may be eligible for burial expenses and a weekly death benefit.

    Disputes often arise between an employee and employer regarding a workers’ compensation claim. Your employer, for example, may dispute your eligibility for compensation or may disagree with your doctor as to the extent of your injuries.
