Product Liability Attorneys
A manufacturer has a responsibility to ensure the products they release into the marketplace are reasonably safe for users. Therefore, when you purchase a product, it comes with an implied guarantee that it is not defective. However, if a manufacturer neglects to properly test or design a product before making it available for sale, anyone injured by that item has legal recourse in product liability law. Unfortunately, countless defective products reach the marketplace and injure consumers each year. According to the U.S. Consumer Product Safety Commission, approximately 300 dangerous products are recalled annually. These products range from appliances to toys, and the injuries they cause can be life-altering.
Types of Product Liability Lawsuits
Product liability lawsuits can be brought against several parties, including the manufacturer, the wholesaler and retail store owners. Many of these cases stem from:
- Manufacturing defects: The most common type of product liability, a manufacturing defect occurs when an error is made during the manufacturing process. For instance, a factory ships 50 swing sets to a department store; however, one of these swing sets has a cracked chain. A mother purchases the set for her child, who suffers an injury because of the defective chain. She can then sue the manufacturer for pain and suffering, medical expensives and punitive damages.
- Design defects: In this form of product liability, the product has an inherently dangerous or defective design flaw. Instead of accusing the manufacturer of a factory error, these product liability claims allege that the entire product line is inherently dangerous.
- Failure to warn of dangers in the product: Failure to warn claims typically arise from products that do not include appropriate warnings or instructions.
- Marketing defects: These product liability claims involve a product that has been falsely or incorrectly advertised.

Yaz Warnings
A popular birth control pill, Yaz has recently come under scrutiny from the FDA for misleading marketing efforts. Specifically, the FDA has warned Bayer HealthCare that the two television advertisements promoting the pill have underplayed its serious side effects and expanded its usage to treat common menstrual symptoms and all types of acne. Currently, Yaz has only been approved to prevent unwanted pregnancy, treat moderate acne and control symptoms of Premenstrual Dysphoric Disorder (PMDD). By expanding the pill's usage and minimizing its side effects, some women may have taken Yaz under false pretenses and may be eligible for a Yaz lawsuit.
Defective Products
The U.S. Consumer Product Safety Commission estimates that there are 300 product recalls every year. In addition to dangerous prescription drugs, products susceptible to recalls include cars, tires, household appliances, children's toys and safety equipment. When these products fail because of defects, the user may suffer brain injury, paralysis, or even death.
