On December 11, 2008 the Food and Drug Administration (FDA) issued a Safety Alert warning consumers that over-the-counter oral sodium phosphate products put patients at risk for acute kidney damage when used at high doses. The FDA Alert stated that due to the risk of acute phosphate nephropathy and kidney failure, over-the-counter laxative oral sodium phosphate products, such as Fleet Phospho-soda, should not be used for bowel cleansing. Consumers should only use oral sodium phosphate products for bowel cleansing if they have a prescription from a healthcare professional.

The FDA Safety Alert also required that prescription bowel cleansers, such as Visicol and OsmoPrep, to include a new black box label warning about the risk of kidney damage associated with their use.

Following the issuance of the FDA's Safety Alert, C.B. Fleet Company announced a voluntary recall of its over the counter Fleet Phospho-soda products. This recall affected Fleet Phospho-soda and Fleet Phospho-soda EZ-Prep Bowel Cleansing System. According to a press release from the C.B. Fleet Company, the decision to voluntarily remove its Fleet Phospho-soda products from the market was in response to the FDA's decision that oral sodium phosphate products should be available by prescription only.

Prior to the recall, Fleet Phospho-soda products were sold over the counter and promoted for use at high doses as a bowel cleanser in preparation for a colonoscopy, radiological procedure, or surgery. However, the safety of using the product at these high doses was never established. In addition, C.B. Fleet continued to market its product as a safe bowel cleanser even after a renal pathologist at Columbia Presbyterian Hospital positively identified cases of kidney failure directly related to the use of Fleet Phospho-Soda as a bowel cleanser in 2003.
