If you object to the Appeals Council’s decision, or the council chooses not to examine your case any further, you have the option to file a civil suit in federal district court—the final step in the appeals process. Civil action is filed for the judicial district of your primary residence or place of business on behalf of the district court of the United States. If you do not reside or conduct business within such a judicial district, this appeal must be filed with the United States District Court for the District of Columbia. You can expect to pay a fee for filing a civil suit in Federal Court.
Time constraints to file civil actionYou have 60 days from the time the Appeals Council denies your request for review or issues an unfavorable verdict to file a civil suit in US District Court.
