Credit Reporting Problems

Violations of the Fair Credit Reporting Act

There are three primary credit reporting agencies that are responsible for keeping track of consumer credit ratings in the United States: TransUnion, Experian, and Equifax. When these agencies make mistakes, it can cause real problems for consumers. The Fair Credit Reporting Act (FCRA) offers consumers protection from credit reporting agencies, banks and lenders who report inaccurate credit information, fail to fix credit report errors, or use a credit report for impermissible purposes.

The attorneys at Morgan & Morgan are committed to helping consumers ensure that their credit reports are accurate and up-to-date. When your credit report contains inaccurate, incomplete, or outdated information, it can have a serious effect on your ability to qualify for loans, credit cards, insurance, and even a job in some cases. Generally speaking, credit information which is over seven years old is considered obsolete under the Fair Credit Reporting Act (FCRA). Bankruptcy can be included on your credit report for ten years. The FCRA also prevents the credit reporting bureaus from selling your information to unauthorized parties.

Don't let your credit history be ruined by inaccurate information. If you need assistance disputing inaccurate or obsolete information in your credit report, the attorneys at Morgan & Morgan can help you today.

If your credit report shows a credit card or other type of account that you did not open, you may be the victim of identity theft. In order to prove you did not open the account, you will need to provide copies of your signature on checks or other documents. Your signature can then be compared to the signature on the fraudulent application. To get the account removed, you will also need a police report about the apparent identity theft and an affidavit swearing that the account is not yours. Our lawyers can help you gather this information and resolve the issue as quickly as possible.

Other inaccuracies that often appear on credit reports include:

  • Incorrect name: If the wrong name appears on your credit report, it can lead to other people's accounts being placed on your credit report. In order to prove your identity and resolve this problem, you will need a document that proves your identity, such as a driver's license.

  • Debts that have been discharged in bankruptcy: If debts that have been discharged in bankruptcy are still present on your credit report, it can cause problems when you try to obtain credit cards and loans. You will need copies of your bankruptcy paperwork to dispute this error.

  • Inaccurate late payments: If your credit report shows late payments when the payments were in fact made on time, you will need the corresponding bank statement to show how much you paid and when the payment was made.

It is always a good idea to review your credit report regularly to see if any inaccuracies or other problems exist. If creditors refuse to remove inaccurate information from your credit report when the necessary proof is provided, you may be able to file a lawsuit and recover compensation. If you have ordered a copy of your credit report and found that the report contains mistakes, contact the lawyers at Morgan & Morgan now. We are dedicated to protecting the rights of victims of credit report errors.
