Bad Faith Insurance Claims

Brian McClain

When an insurance company unfairly denies an insurance claim, the claimant may have a case for "bad faith." To prove bad faith, the claimant must show that the insurance company failed to honor their contract and did not have a valid reason for denying, delaying or underpaying the insurance claim. Failing to promptly investigate a claim, unreasonably delaying payment and manipulating contract language are all examples of insurance bad faith.
